In the event that a matter is brought in the Federal Courts of the United States and no diversity jurisdiction exists, then the matter must proceed under the Court’s admiralty jurisdiction and Guest may not be allowed a trial by jury. If a matter proceeds under the Court’s admiralty jurisdiction, then Carnival consents to a trial by jury pursuant to Federal Rule of Civil Procedure 39(c).
